The law was clear that the giant automobile companies could deal with one retailer in a community or area and refuse to sell to any other without running afoul of the law. That was and is a common law principle that has not in any way been modified by the Sherman Antitrust Act or any other act of Congress. They maintained, and still do, that no dealer is compelled to purchase from any particular distributor or, for that matter, from a distributor in his own area. They further contend, and still contend, that there were at all times and still are many places where there is more than one distributor or hardware wholesaler selling in the same area and that in fact there exists everywhere a free and competitive market between all of their distributors. F. Goodrich bicycles, sold in tire stores, Schwinn eliminated the practice of producing private label bicycles in 1950, insisting that the Schwinn brand and guarantee appear on all products. In exchange for ensuring the presence of the Schwinn name, distributors retained the right to distribute Schwinn bikes to any hardware store, toy store, or bicycle shop that ordered them. W. Schwinn’s share of the U.S. bicycle market fell from 22.5 per cent in 1951 to 12.8 per cent in 1961. In the latter year, the largest domestic bicycle producer had a 21.8 per cent market share. While every large bicycle manufacturer sponsored schwinn beach cruiser or participated in bicycle racing competition of some sort to keep up with the newest trends in technology, Schwinn had restricted its racing activities to events inside the United States, where Schwinn bicycles predominated.

Of course, no cycle distributor carried all makes of bicycles, but any self-respecting and progressive distributor carried an ample range of makes and prices to satisfy all of its customers. Some distributors pushed low-priced, and of course low quality bicycles, and ignored quality-priced and quality products in the bicycle field, such as Schwinn.
